These Terms of Service (“Terms”) govern your access to and use of the SilkaGlow website, mobile experiences, AI-powered services, digital products, cosmetic products, subscriptions, educational content, and all related services available through www.silkaglow.com and any affiliated websites or applications (collectively, the “Services”).

By accessing, browsing, creating an account, purchasing a product, subscribing to a service, interacting with GlowMatch AI, SilkaGlow AI, or otherwise using any part of our Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and all policies referenced herein.

7. No Professional Medical Advice; Emergency Situations

SilkaGlow provides cosmetic products, beauty education, AI-powered beauty tools, and general informational content. Nothing available through the Services—including AI-generated recommendations—constitutes medical advice, diagnosis, treatment, pharmaceutical guidance, emergency care, or healthcare services.

Use of the Services does not create any physician-patient, dermatologist-patient, pharmacist-patient, therapist-client, or other healthcare provider relationship.

Customers should consult qualified healthcare professionals regarding medical concerns, allergies, pregnancy, medications, skin disorders, or any condition requiring professional evaluation.

Our Services are not designed for emergencies. Do not rely on GlowMatch AI, SilkaGlow AI, website content, or customer support for emergency medical assistance. If you believe you are experiencing a medical emergency, call your local emergency services immediately or seek immediate medical attention.

8. AI Services

GlowMatch AI, SilkaGlow AI, virtual consultations, quizzes, image-analysis features, voice interactions, educational tools, and future AI-powered experiences (collectively, the “AI Services”) are intended solely to provide informational, cosmetic, educational, and shopping assistance.

Artificial intelligence may produce inaccurate, incomplete, outdated, or inappropriate information. AI recommendations should always be independently evaluated before being relied upon. You remain solely responsible for decisions made based upon AI-generated information.

The AI Services are not intended to diagnose, treat, cure, prevent, monitor, or manage any disease, medical condition, mental health condition, or other healthcare need. By submitting User Content, you grant Silka Glow Essentials LLC a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, display, publish, distribute, modify solely for formatting or display purposes, and otherwise use the content in connection with operating, marketing, improving, or promoting the Services, subject to our Privacy Policy.

You represent that your User Content is truthful; does not infringe another person’s rights; does not contain unlawful, defamatory, threatening, abusive, or misleading material; and does not violate applicable law.

We reserve the right, but not the obligation, to remove User Content at our sole discretion.

25. Digital Services and Availability; Beta Features

The Services are provided on an “as available” and “as is” basis. We do not guarantee that the Services will be uninterrupted, error-free, secure, or available at all times. Maintenance, software updates, technical failures, internet outages, cybersecurity incidents, or circumstances beyond our reasonable control may temporarily affect availability.

We reserve the right to modify, suspend, discontinue, or replace any feature of the Services at any time.

From time to time, SilkaGlow may release experimental or beta features. Beta features may contain bugs, errors, interruptions, or incomplete functionality. By using beta features, you acknowledge that such features are provided for evaluation purposes without guarantees regarding performance or availability.

26. Subscriptions

Certain AI features, memberships, or digital Services may require a paid subscription. Subscription pricing, billing frequency, automatic-renewal terms, trial periods, cancellation procedures, and included benefits will be disclosed before enrollment.

Unless otherwise stated, subscriptions automatically renew at the end of each billing period until canceled. By enrolling, you authorize us or our payment processor to charge the applicable recurring subscription fee and any disclosed taxes to your selected payment method.

You are responsible for canceling your subscription through the cancellation method provided within your account or subscription-management page. Cancellation must be completed before the next scheduled renewal date to prevent the next recurring charge.

Cancellation will take effect at the end of the current paid billing period. You will continue to have access to the applicable subscription benefits until that billing period ends, unless otherwise required by law or expressly stated at the time of cancellation.

Unless required by applicable law, payments already charged are non-refundable, and no refunds or credits will be issued for partially used billing periods.

We may modify subscription plans, pricing, or included features upon reasonable advance notice, as permitted by applicable law.

27. Communications; Electronic Communications

By creating an account or making a purchase, you may receive non-marketing operational communications relating to your orders, account, security, billing, subscriptions, customer support, and other service-related matters, where permitted by applicable law. These operational communications are separate from optional SMS marketing consent.

Marketing communications will be provided only in accordance with your communication preferences and applicable law. You may opt out of promotional communications as described in our Privacy Policy.

By using our Services, you consent to receive notices, disclosures, agreements, receipts, confirmations, and other communications electronically where permitted by applicable law. Electronic communications satisfy any legal requirement that such communications be provided in writing.

SilkaGlow offers two optional SMS message categories:

2. Marketing

Informational messages may include customer support, order and account updates, subscription or membership communications, trial and renewal reminders, personalized skincare and beauty guidance, routine reminders, wellness check-ins, service notifications, and other communications related to your relationship with SilkaGlow.

Marketing messages may include promotional offers, discounts, product launches, restock announcements, product recommendations, new products and services, and other SilkaGlow promotional communications.

You may voluntarily consent to receive Informational messages, Marketing messages, or both by actively selecting the applicable SMS consent option on the SilkaGlow website and submitting your mobile number.

SMS consent is optional and is not a condition of purchasing any goods or services, accessing SilkaGlow, using our services, subscribing, or participating in the IQ GlowMatch™ experience.

EXCEPT AS EXPRESSLY REQUIRED BY LAW, SILKA GLOW ESSENTIALS LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, OR UNINTERRUPTED OPERATION.

29. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SILKA GLOW ESSENTIALS LLC, ITS OWNERS, MEMBERS, EMPLOYEES, OFFICERS, DIRECTORS, CONTRACTORS, AFFILIATES, SUPPLIERS, SERVICE PROVIDERS, LICENSORS, SUCCESSORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES ARISING OUT OF OR RELATED TO THE USE OF THE SERVICES OR PRODUCTS.

THIS INCLUDES, WITHOUT LIMITATION: LOSS OF PROFITS; LOSS OF DATA; LOSS OF BUSINESS; LOSS OF REPUTATION; BUSINESS INTERRUPTION; LOSS OF GOODWILL; COMPUTER FAILURES; AI ERRORS; WEBSITE OUTAGES; DELAYED DELIVERIES; CUSTOMER DECISIONS BASED UPON AI RECOMMENDATIONS; AND THIRD-PARTY SERVICES.

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR PRODUCTS SHALL NOT EXCEED THE AMOUNT PAID BY THE CUSTOMER FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

NOTHING IN THESE TERMS LIMITS LIABILITY WHERE SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAW.

30. Product Safety

Customers are responsible for using products only as directed. Customers should read all instructions, review ingredient lists, perform patch testing when appropriate, discontinue use if irritation occurs, and seek medical attention if serious reactions occur.

SilkaGlow is not responsible for injuries or damages resulting from misuse, abuse, alteration, improper storage, failure to follow instructions, use after expiration, use contrary to warnings, or use in combination with incompatible products where such incompatibility was not reasonably foreseeable.

31. INDEMNIFICATION

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Silka Glow Essentials LLC, its owners, members, employees, officers, directors, contractors, affiliates, licensors, suppliers, successors, and agents from and against claims, liabilities, damages, judgments, settlements, penalties, fines, losses, costs, and reasonable attorneys’ fees arising out of or related to: your violation of these Terms; your misuse of the Services; your violation of applicable law; content you submit; infringement of another person’s rights; fraudulent activity; or unauthorized use of your account.

32. THIRD-PARTY SERVICES

The Services may integrate with or link to third-party websites, payment processors, shipping carriers, AI providers, social-media platforms, analytics providers, or other independent services. SilkaGlow does not control these third parties and is not responsible for their content, security, availability, products, services, policies, or actions. Your use of third-party services is governed by their respective terms and privacy policies.

33. FORCE MAJEURE

Silka Glow Essentials LLC shall not be liable for delays or failures resulting from events beyond our reasonable control, including natural disasters, severe weather, pandemics, epidemics, war, terrorism, labor disputes, internet failures, cyberattacks, governmental actions, utility interruptions, transportation disruptions, transportation embargoes, supplier failures, supplier recalls, shortages, or other events that could not reasonably have been prevented.

34. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.

35. DISPUTE RESOLUTION

Before filing a lawsuit, both parties agree to make a good-faith effort to resolve any dispute through direct written communication.

If a dispute cannot be resolved informally, either party may pursue any remedies available under applicable law in a court of competent jurisdiction.

Nothing in these Terms limits any rights that cannot legally be waived.

36. TERMINATION

We reserve the right to suspend, restrict, or terminate access to the Services, with or without notice, if we reasonably believe a user has violated these Terms, engaged in fraudulent activity, created legal or security risks, or otherwise acted in a manner harmful to SilkaGlow, its customers, or third parties. Termination does not affect obligations or rights that accrued before termination.

Sections relating to intellectual property, warranties, limitation of liability, indemnification, dispute resolution, payment obligations, and any provisions that by their nature should survive termination shall remain in effect after termination.

37. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

38. WAIVER

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

39. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Shipping Policy, Refund Policy, Cookie Policy, Consumer Health Data Privacy Notice (where applicable), and any other policies expressly incorporated by reference, constitute the entire agreement between you and Silka Glow Essentials LLC concerning the Services.
